Custody and Visitation

Custody and Visitation Lawyer – San Jose, CA

When two parents decide to divorce, many things have to be settled, including child custody, child visitation and child support issues. Even if parents cannot get along or argue over other aspects of the divorce, for the sake of the children they should try to come to an agreement about custody and visitation, or at the very minimum, ensure that the children do not realize there is a custody battle.

A San Jose child custody attorney can help you with your custody and visitation issues. Issues that could cause a tough custody battle include but are not limited to:

  • A spouse that tries to alienate the children against the other spouse;
  • A spouse that absconds with the children and hides;
  • A spouse that absconds with the children and brings them to another country;
  • A spouse that wrongly accuses you of child abuse to get the children away from you;
  • Temporary child support until the divorce is final;
  • Permanent child support according to the California child support guidelines; and
  • Visitation issues, including a spouse that is late picking up or returning the children.

Contact a child custody and visitation lawyer in San Jose if you have any of these issues or other issues involving child support, custody or visitation.

A San Jose child custody attorney will also help you work out a fair visitation schedule. A visitation schedule must be more than fair to the parents. It must be in the best interest of the children. A typical visitation schedule might include every other weekend, one weekday overnight and rotating holidays, but this may not work for some parents, because of their work schedule. If you live close enough to your spouse or ex-spouse, you could opt for shared custody. The children live with one parent for a specific amount of time, then the other parent for the same amount of time. Holidays still rotate, unless the parents decide that they prefer to celebrate the holidays as a family.

Parents that get along with each other may also opt to have an open-ended visitation schedule. The only “set” schedule is a basic schedule that includes every other weekend and rotating holidays, but the final judgment or the settlement agreement states that visitation occurs as often as the children want it, and that should an argument ensue over visitation that the parties would refer to the schedule contained in the final judgment or agreement.

Contact a child custody and visitation lawyer in San Jose to discuss various options for custody and visitation, child support guidelines and other custody issues.
