K Visas

There are 4 types of K visas:

American citizens may sponsor a K-1 visa for a fiancé by first filing a Petition for Alien Fiancé, at the USCIS office servicing the sponsor’s resident area. The approved form will be sent to the U.S. embassy or consulate where the fiancé must apply for a visa. The embassy or consulate will contact the American sponsor with further instructions. Unmarried, under-21 children of the noncitizen fiancé may file for a K-2 visa once the Petition for Alien Fiancé is approved, provided each child was listed separately on the Petition.

Applicants for a K-3 visa must be married to a U.S. citizen. The citizen spouse must file an Alien Relative petition, with USCIS first. In addition, they need to file and get approval on Petition for Alien Fiancé, must be provided to the U.S. Consulate with jurisdiction over the country where you were married. For applicants who were married in the U.S., the Petition for Alien Fiancé should be turned in at the U.S. consulate covering the area where applicant is currently a legal resident. Unmarried children under 21 years of age with a parent eligible for a K-3 visa are eligible for a K-4 visa. A separate visa request must be filed for each child.
