What are the requirements for an E-1 visa?
Under United States immigration law, E-1, or Treaty Trader, applicants must meet the following requirements:

  • The applicant must be a national from a treaty country;
  • The organization must originate from a treaty country;
  • The organization must engage in “substantial” volume of trading;
  • The organization’s volume of trade is primarily (more than 50 percent) with the United States;
  • The applicant is either a supervisor or executive of the organization;
  • The applicant possess skills key to the establishment and/or operation of the business.

What documentation is needed to apply for an E-1 VISA?

Applicants will need:

To complete Online Nonimmigrant Visa Electronic Application, Form DS-160;

  • To complete Nonimmigrant Treaty Trader/Treaty Investor Application, Form DS-156E,
  • A valid passport
  • One 2×2 color photograph

To apply for an E-1 Treaty Trader visa, or an E-2 Treaty Investor visa, the U.S. must have a treaty in place with the foreign citizen’s country of citizenship. See the following list to review these treaties.
