E2 Visa

E-2 VISA Attorney – San Jose, CA

E2 visas are provided to individuals who are a national of a country that the United States possesses treaties of commerce and navigation with. These individuals are known as “treaty investors,” and they are provided short-term visas to promote investment and foreign commerce.

Requirements

Treaty investors seeking an E2 visas must prove that they have either made a substantial investment in business, services, or technologies between the US and their home nation, or the treaty investor must prove that they direct a business that has invested or will soon invest a substantial amount in American business. The treaty investors with E-2 visas must own, be in the process of acquiring, or be in the employment of a business that owns at least 50 percent of the investment in question. Please note that although E2 visa investments typically are over $50,000, the term “substantial” varies between situations as the US Citizenship and Immigration Service defines it as “substantial in relationship to the total cost of either purchasing an established enterprise or establishing a new one.”

Application Process

E2 visas are typically acquired through the US Embassy or Consulate with jurisdiction over the treaty investor’s home country. Any person between the ages of 14 and 79 must be interviewed by the embassy consular section to acquire a visa. However, the exact requirements for E2 visas vary between countries. Our expert E2 visa lawyer in San Jose can provide you with the exact requirements based on your country of origin. Further it can also be helpful to contact a San Jose based E2 visa attorney before submitting your visa application to make sure that it complies with all requirements necessary; otherwise, your visa could be delayed.

Family Status

E2 visas typically last for up to two years. Legally recognized spouses and children under the age of 21 may accompany an E2 visa holder for the duration of their stay under derivative status. Our expert, San Jose based E2 visa lawyer can assist with the documentation needed for allowing family to stay under this derivative status.

Completion of Business

Once the business proposition under which the E2 visa is acquired is completed, an individual has six months to leave the United States or change their visa status. Again, our qualified San Jose E2 visa attorney can best advise you what steps to take at this point to best your needs.
