EB-2 Visa Requirements For Professionals With Advanced Degrees

  •   The EB-2 visa petitioner must be prepared to submit academic records or transcripts as proof of an advanced degree. These can be from a U.S. college or university or a foreign college or university.
  •  If the EB-2 visa petitioner is alleging the equivalent of an advanced degree, he or she must submit proof of a baccalaureate degree, either from a US college or university or its foreign equivalent, plus letters from employers documenting at least five years of work experience in the petitioner’s major field.
  •  An EB-2 visa petition filed on behalf of a professional with an advanced degree must be accompanied by a certification from the Department of Labor. The correct Department of Labor form is Form ETA-750.
  • Once the labor certification is obtained, employers must file an Immigrant Petition for Alien Worker, Form I-140. In certain rare instances, if the alien worker is exceptionally well qualified, he or she can self-petition.
